Prosecutors have appealed the mid-trial acquittal of Shannon Wilson and are seeking a new trial.
Wilson, who is also known as Ramon Wilson, was charged with attempted murder after he allegedly pointed a gun at an officer in 2016.
According to the prosecution’s case, two officers went to Wild Guava Street in 2016 to investigate a complaint.
They saw Wilson who fit the description of the suspect.
Wilson allegedly pulled a loaded gun and pointed it in the direction of the officers.
However, he dropped the gun before he could fire when an officer shot him in the thigh.
Police recovered a 9mm pistol loaded with seven rounds of ammunition.
Prosecutor Jacklyn Burrows argued that the officer could have been seriously wounded if he had a chance to fire his weapon.
Burrows said the trial judge could have left the alternative charges of assault with a deadly weapon and possession of a firearm to evade arrest for the jury.
However, Wilson’s lawyer Anthony Delaney defended the judge’s decision to dismiss the case at the close of the prosecution’s case.
Justices of Appeal Sir Michael Barnett, Jon Isaacs and Roy Jones have reserved their decision in the case.
