Goodman seeking permission to appeal conviction

The Court of Appeal will on Friday continue to hear arguments on whether convicted child killer Kofhe Goodman should be granted permission to appeal.

Goodman, otherwise known as Eduardo Ferguson, was convicted of the murder of 11-year-old Marco Archer following a second trial in May 2017.

The schoolboy went missing after leaving his mom’s Brougham Street home on September 23, 2011, to buy candy. His naked and decomposing body was found wrapped in a sheet near Goodman’s home on Yorkshire Drive. The child’s clothing was found in a garbage bin in front of the residence.

Goodman was sentenced to 55 years, less the time spent on remand in May 2018.

Goodman had 21 days to file notice of an appeal against his conviction.

He let the deadline pass and now Public Defender Stanley Rolle is trying to convince the court to hear the appeal, despite the 28-month delay in filing.

According to Rolle, Goodman has good prospects of success should the appeal be heard.

Rolle attacked the competence of Queen’s Counsel Wayne Munroe, who represented Goodman.

Director of Public Prosecutions Garvin Gaskin said the attack on Munroe’s representation was peculiar, as Munroe had successfully challenged Goodman’s first conviction.

Gaskin said Goodman’s subsequent conviction had prompted a “vituperative” response.

Rolle criticized Munroe for failing to call Goodman’s alibi witnesses.

In an affidavit in response, Munroe said that the time period for the commission of the offense was too broad for alibi testimony to be effective.

Gaskin, who is assisted by Cordell Frazier, continues his arguments against the appeal on Friday.

Justices of Appeal Sir Michael Barnett, Jon Isaacs and Roy Jones are hearing the matter.
