Convicted conman pardoned prior to appeal, court told

Convicted conman Shane Mackey was released from prison earlier this month after he received a pardon from the governor general.

Mackey, 39, who has an extensive criminal history, was sentenced to 36 months in prison in 2019 for convincing 11 prospective car buyers to pay him a collective $50,000 for vehicles he didn’t own.

He was set to appear before the Court of Appeal on Monday to receive credit for the time he’d spent in custody since he was remanded in 2018.

Mackey was freed from prison in 2017 for the same offense.

However, Mackey was released from prison on March 5.

Assistant Director of Public Prosecutions Linda Evans told the court, “According to information received from prison authorities, Mr. Mackey was released on March 5, 2021 after being pardoned by the governor general.”

Evans told the panel of Justices of Appeal Sir Michael Barnett, Roy Jones and Milton Evans that she had not received confirmation of Mackey’s pardon in writing.

As a result, Sir Michael adjourned the matter to March 30 to receive the instrument of pardon to officially close out the court’s file.
