A magistrate yesterday discharged a 56-year-old man accused of assaulting two security guards with his truck at the city dump.
William Major pleaded guilty to two counts of assault with a dangerous instrument at his arraignment before Senior Magistrate Derence Rolle-Davis.
Prosecutors alleged that Major tried run over the men with his Chevrolet truck in a dispute over ownership of four car rims he had found.
In mitigation, Major’s lawyer, Ian Cargill, said that Major went to the dump to offload trash. While there, he found four car rims that he decided to remove.
However, Cargill claimed that the security guards wanted the rims for themselves and tried to fight Major, who drove off in his truck.
Cargill said that Major had told police from the outset that surveillance footage would support his version of events.
Due to the discrepancy, Rolle-Davis asked prosecutor Sergeant Kenny Thompson to view the complainants’ statements.
After reviewing their accounts to police, Rolle-Davis said that the accounts of the officers did not coincide.
Therefore, he found Cargill’s account more plausible.
He granted Major an absolute discharge, meaning no conviction was recorded.
