A judge has set a retrial date for two men accused of conspiracy to commit murder, whose convictions were overturned by the Court of Appeal last December.
Justice Guillimina Archer-Minns set an October 19 trial date for Rashad Sullivan and Patrickedo Rose, who are accused of plotting the 2012 murder of Dario “China” Knowles.
At appeal, defense lawyers Roberto Reckley and Devard Francis convinced the court that the trial judge prevented the men from challenging the voluntariness of their alleged confessions, by failing to order police to disclose complaints from prosecution witnesses of police brutality.
The court ruled, “I agree that the appellants were denied the opportunity to advance their case on the voir dire that the police investigation had been conducted in such an environment of abuse and oppression that not only were they beaten to confess, but additionally, prosecution witnesses had also been beaten to give witness statements, which implicated them.”
