Mother fell on baby while under attack 

Magistrate's Court Complex.

A magistrate on Friday deferred punishment for a Haitian man and woman who beat up a woman as she held an infant.

Jeffrey Lubin, 24, and Rosna Noel, 52, pleaded guilty to assaulting Francesca Sanon and exposing her two-month-old son to grievous harm.

The baby suffered facial injuries when his mother fell on top of him during the assault at a Haitian Village on Cowpen Road on June 7.

The prosecutor, Inspector Lakesia Moss, told Senior Magistrate Derence Rolle-Davis that the child had surgery and was recovering in hospital.

As of June 12, the child was in “fairly stable” condition at the hospital, the investigating officer told the court.

According to the prosecutor, Sanon had an argument with Lubin, her boyfriend and the infant’s father, on June 6.

As a result, she went to sleep by Noel, her mother.

However, Noel also allowed Lubin to sleep at the home when he came there, the court heard.

Sanon left the house the following morning. Her two-year-old son walked alongside her as she held the infant in her arms.

But Lubin came after her and grabbed her free hand and told her “she wasn’t going anywhere”.

As he dragged her back to the house, Sanon screamed for help.

Her mother came out but didn’t render any assistance. Instead, she struck her daughter in the back and bit her hand.

Sanon fell on top of the infant that she cradled in her arms and the two-year-old also fell to the ground, the court heard.

Then Noel took both children back to the house.

Moss told the court that a bystander, who recorded the assault on his cellphone, gave police the footage.

The magistrate viewed the recording on his laptop.

Rolle-Davis also wanted to hear from Sanon. However, she was too overwhelmed to talk.

Sanon will address the court on June 24 before Rolle-Davis passes sentence.

The magistrate has also requested an updated medical report before sentencing.

Lubin’s lawyer, Ian Cargill, said that he was remorseful for his actions.

Noel’s attorney, Keith Bell, echoed those sentiments.

The convicts are on remand at the Bahamas Department of Correctional Services in the interim.
