Community leader and businessman David Humes was fined $1,200 for making conch salad at his sporting lounge while not wearing a protective face mask.
Police arrested Humes, 36, along with his worker, Noel Villa, 30, at F2K Lounge on University Boulevard around 3:20 p.m. on Wednesday.
Both men admitted flouting the lockdown and operating a non-essential business at their arraignment before Chief Magistrate Joyann Ferguson-Pratt. Humes also admitted ignoring the mandatory requirement to wear a mask in public.
According to defense lawyer Roberto Reckley, Humes went to the grocery store to get some items when customers called him and requested conch salad.
He said that Humes and Villa went to the lounge to prepare the orders that he intended to deliver to the customers.
Reckley described Humes as a community leader in the area off Nassau Street known as Harlem.
He said that Humes’ arrest came as a surprise as the last time he went to his barbershop on Nassau Street, he said that people needed to stay home.
Reckley said that Humes’ barbershop had been affected by the restrictions.
In passing sentence, the magistrate said the restrictions were not a “whimsical act”, as the country is experiencing a “disturbing public health phenomenon”.
Since Villa was acting on the instructions of his employer, Ferguson-Pratt fined him $500.
They both faced the alternative sentence of two months in prison for non-payment.
